I have read the car was side swiped .If I was the owner and that happened . The other party's insurance company wanted to total it I would say this to the other party's insurance agent you fix the car or I will have my attorney handle this .

This is where you are very wrong. Being that I was in the collision industry for 23+ years. A car has X value based on current market values. Unless you have stated value I insurance you are only entitled to market value. If there are no available parts to repair the car it's not deemed fixable. So if you feel or think your attorney has leverage in this your sadly mistaken everything revolves around $$$$$ ending result you don't have coverage you don't get car fixed end of story

I knew some one whose 1970 monte carlo was hit by some idiot running a stop sign . The other driver insurance company was going to total it and give him $50.00 ( I was told about this from the owner of the Monte carlo) He threatened to sue and he got the money and got the car repaired.
When I wrecked my '57 plymouth back in 1987 I knew about a salvage yard in GA that had a couple of '57 plymouths in it . I could of gotten the parts to get the car repaired. There was also a body shop next door to the impound yard were my '57 he told me he looked at my car and said it could of been repaired.

Spot on. Down this way, we have the option to buy it back cheaply after the payout. "repairable write off".
