Fed Road Tax is 18.3 cents on gas and gasohol and 24.3 cents on Diesel.

Off road fuel for AG and ATV use is dyed Red.
It is a very staining dye and just one tank will permanently color the fill pipe and any place else the gas flows.

A friend ran out of gas in his truck and had a 250 gal tank and pump on the bed full of off road gas.

I asked why not put in enough to get him to the station and he said it was not worth it, due to the staining.

Any inspection would cause him big trouble...

Road and transit taxes, among others, are added to fuels sold for use on public roads that aren't added to marine, farm, and avgas. Use of those fuels on public roads amounts to tax evasion here so one must be careful what he/she admits to on public forums I would think. Going back 20 or more years ago, locals in farm communities around here sometimes had their fuels sampled by police to ensure they were not running 'illegal' fuel. The color was always the give-away as dyes were added to all fuels to identify more than just octane ratings.

I'd be interested to know if this is still the case or if it was ever an issue in the USA?

Here in Dayton (and I suspect many other areas around the country) I get non-ethanol 100 octane leaded gas at my local private airport. They just take my 5 gallon container and fill it right out of the fuel truck. No questions asked.
