Expert Posts: 1348 Location: Valley Forge, Pa. | I was ordering my custom made postage stamps again and, as before, I have a picture of my car on them but this time I added the tex "The Forward look" and the company says they can't make them. They have made the same stamp for me several times before. I am waiting a reason from them but I was wondering if the term is copyrighted? If so, how can it be or how could i use it that would not infringe on the copyright IF it is? I tried to get a stamp made of my 1967 GTO but they said because it had GTO on the grill, I couldn't use the picture. I am using a total side view of my wagon and there are no scripts or names on the side of a 1960 Plymouth Suburban. I also tried to get a sheet of atamps with a picture of my pet skunk and a caption saying "THINKING OF YOU" and they said it wasn't acceptable. Shame, that was going to be my bill paying stamp. Location: Indiana | just doing a minor dig, the best example i can find is Nike's "Just Do It", it is *NOT* copyrighted, it is TRADEMARKED... you can copy the company slogan of your local plumber and apply it to a t-shirt or stamp because the plumbing company only trademarked it as a company slogan and NOT to "clothing" or to "postage stamps", *IF* they trademarked it at all... did MoPar "trademark" the campaign slogan? something tells me NO, they did not, and you can use it on your postage stamp... or a t-shirt... or a frisbee... or a mailbox... or a pair of cuff links... you just can't use it for a car commercial *IF* if was trademarked as such back in the day... i'm guessin' the admin on this forum will really know best... something tells me you can use "The Forward Look" for your postage stamp or a t-shirt or whatever your heart desires, just not as a marketing campaign to sell cars... | ||

Unfortunately, it only goes back to 1985[I think] and before that I believe you need to go there in person and look through paper files. There is probably a similar site for searching Trademarks, I guess? | ||

Expert Posts: 2312 Location: Arizona | I thought that if you didn't keep using trademarks by actually producing and selling the product that you lost it. That's supposedly one of the reasons companies like Dial and Procter and Gamble will have a single store somewhere still selling toothpaste labeled "Fresh N Bright" so that someone else can't take the "name". It would be why when Dodge stopped producing the Matador after 1960 AMC was able to use Matador as the name for one of their models in the 70's. It would mean that if MoPar gave up "The Forward Look" someone else could latch onto it IF they actually were selling something by that name and they trademarked it. That's just my intuitive belief based on what I've heard and observed over the years. | ||

Location: Indiana | some copyrights and trademarks are not "transferrable"... meaning that when the original author, artist, creator, owner, etc dies, not even the family can "own" the copyright or trademark, it rolls over into PUBLIC DOMAIN... | ||

Expert Posts: 1348 Location: Valley Forge, Pa. | This time they DID print my stamps. I didn't ask for $.35 but that what they came as. They were supposed to be $.49 and I had designed the white background area to be a lite gold color. Oh well, at least they are in plenty of time for Xmas cards. As far as them being $.35, that's OK as I have sheets and sheets of vintage $.06 + $.08 stamps. I like to mail stuff rather than do my business on-line, so I go through a lot of stamps. I have 100s of full pages of stamps from my collection that I am now using. Sad thing is my 40+ year old stamps are worth less than their face value, so if YOU also prefer to mail your payments, but have been going to the P.O. for "Forever" stamps, check out ePay or similar site. You can buy any amount of face value of old unused stamps or even "Forever" stamps at less than their actual face value and usually FREE SHIPPING. Sorry for the poor picture. Expert Posts: 1348 Location: Valley Forge, Pa. | OMG! I am sooo ashamed! I guess I did that and never even noticed until you pointed it out. I must have looked at it 20 times and was so concentrating on eveything else. I can not blame that on anyone but me and if you didn't say anything, I probably would have never noticed it. I have to go back and look at the original order. I don't see how I could have done that and they difinately didn't print it exactally as I ordered. They also sent me a survey with my order and allowed me to state my opinion about their product. I told them I was not happy the way they handled my request before. I could have POed them off but I really don't think they would deliberately change it. It has to have been my mistake. I'm sorry if I offened anyone, but if it is my mistake, it is sort of funny to me anyway and I don't even like fords. | ||
